3 – A preliminary hearing is a hearing to determine whether or not there is sufficient probable cause to believe a crime was committed and whether or not the accused committed it. The prosecution is required to present sufficient evidence to convince a judge there is sufficient probable cause to continue with the case.
At the preliminary hearing, witnesses will testify as to what they heard and saw.
