Felony Criminal Charges

FELONY CHARGES AND PROPOSITION 47

Felony charges are crimes that can be punished by imprisonment in the state prison. Recently, the California voters passed Proposition 47, which makes crimes that were previously prosecuted as felonies now misdemeanors. Certain theft crimes such as shoplifting where the value taken is less than $950.00, and simple possession of drugs, are now punishable as misdemeanors. Please note that certain individuals with prior convictions may not qualify under proposition 47 and their felonies may not be reduced to misdemeanors.

Criminal defense attorney Christian M. Ham has handled hundreds of criminal cases, ranging from homicide to complex mortgage fraud. He has handled many high-profile cases, including kidnapping for ransom, conspiracy to commit murder, and drug trafficking. Mr. Ham has successfully represented individuals facing prison sentences of 25 years to life, as well as life without the possibility of parole. He has won dismissals before and during jury trials, at preliminary hearings, and after prevailing at speedy trial and suppression hearings. He has tried multiple cases resulting in not guilty verdicts.

Mr. Ham practices criminal defense primarily in San Diego and has successfully represented clients in the counties of Orange, Los Angeles, Riverside, and San Bernardino. Mr. Ham takes pride in his commitment to providing his clients with the highest level of criminal defense.

California punishes strike offenses much harsher than regular felonies. A strike conviction can have a devastating and long lasting effect. A felony conviction with two prior strike convictions can result in 25 years to life imprisonment. There are two types of strikes: serious and violent.

The following is only a small list of serious felonies and therefore strikes under California Penal Code section 1192.5; please note we list only 11 and many other serious strike offenses not listed here:

  • Murder or voluntary manslaughter
  • Mayhem
  • Rape
  • Sodomy by force…
  • Oral copulation by force…
  • Lewd or lascivious act on a child under 14
  • Any felony punishable by death or life in prison
  • Any felony where defendant inflicts great bodily injury or uses a firearm
  • Attempted murder
  • Assault with intent to commit rape or robbery
  • Burglary of the first degree; residential

The following is a list of some “violent strikes” under California Penal Code section 667.5; please note that there are many more violent strikes that are not listed here:

  • Murder or voluntary manslaughter
  • Rape
  • Sodomy by force…
  • Oral copulation by force…
  • Lewd or lascivious act on a child under 14
  • Any felony punishable by death or life in prison
  • Any felony where defendant inflicts great bodily injury or uses a firearm
  • Attempted murder
  • Robbery
  • Arson

Strike convictions have a tremendous and potentially devastating effect because any future conduct will be punished more severely. It is important to consult with an experienced attorney to determine the consequences of a strike conviction. If you are charged with a strike offense or have a prior strike conviction, Mr. Ham can explain the potential outcome of your case and help you through this difficult process.

VIOLENCIA DOMESTICA

Defending the Accused

Every person accused of a criminal offense has a constitutional right to an attorney. Being accused of a crime comes with the difficult possibility of going to jail. Having a lawyer do everything possible to avoid or limit the amount of jail is often a priority. A good criminal defense attorney can review the evidence and identify legal issues. These issues can be used to negotiate with the prosecuting attorney and reach a favorable resolution of the case
